Maryland at present time is not as strict as the State of West Virginia on Lead Paint in pre 1978 built homes or commercial daycare centers. According to one licensing official in the state office, it is their duty to report any signs of cracked or peeling paint to the Maryland Health Department. Upon such notice they ( The Health Department) will proceed from there.

 

Below you will see the actual COMAR REGULATIONS as it was taken from the State of Maryland. This means that you as a daycare provider must comply by not using lead based paint and that you should take proper measures if you know lead based paint is present on older properties used for daycare.

 

With the liability exposure and the more Lead Based Paint Hazards is promoted by the state you should consider protecting both your daycare children and yourself. Keep in mind that not all lead based paint is a hazard. We suggest that you have your daycare tested and see just what is there. Our testing is done using an XRF gun and we can give you a detailed report on what lead based paint may exist if any. Lead based paint can be very dangerous in a child under six years old, why take the chance.

This chapter of regulations was previously codified as Code of Maryland Regulations (COMAR) 07.04.01. Effective January 1, 2006, the chapter was re-codified as COMAR 13A.14.01.

C. Lead Paint.

(1) A provider may not use paint with lead content on any:

(a) Exterior or interior surface of the home; or

(b) Material or equipment used for child care purposes.

(2) If the home was constructed or renovated before 1978, the provider shall ensure that paint on any surface in an area used for child care is tested for lead content according to procedures established by the Office:

(a) If the paint is chipping, peeling, flaking, chalking, or deteriorated; or

(b) Before renovating the surface.

(3) If testing completed pursuant to §C(2) of this regulation reveals a lead content level that exceeds the maximum allowable lead level set by applicable State or local law, the provider shall follow the:

(a) Guidelines developed by the Office for a lead paint management plan; or

(b) Lead paint abatement procedures set forth in COMAR 26.02.07.
